General Terms and Conditions

  1. Defined terms: Defined terms are set out at the end of these Terms.

  2. Eligibility: Alberts membership is offered to persons who are at least 18 years old on or before the date accepted as a Member of Alberts or from the date that payment is approved. Alberts management reserves the right to ask you to present valid identification including, without limitation, a government issued picture ID, upon arrival at Alberts.

  3. Alberts Membership:

(a) These Terms need to be agreed by you before you can commence your membership. If there is anything that you do not agree with or do not understand in these Terms, please do not accept them, and contact us with your concerns at membership@alberts.nz.

(b) We will endeavour to provide our services to the best of our ability. We value your feedback, and if we are not meeting your expectations, please let us know so that we can find a way of addressing this.

(c) Your membership is personal to you. You may not transfer your membership to someone else.

(d) You agree to comply with your obligations under these Terms, and with any additional obligations contained in any of our policies which may be updated from time to time.

  1. Membership Types:

(a) Annual House Membership – Annual House Memberships are annual and begin on the membership start date. Membership renewals are automatic and take place on an annual basis after the initial Membership Term. All memberships are non-refundable and cannot be placed on hold.

(b) Monthly Memberships – Monthly Memberships have different commitment terms. We have gold, silver, and bronze memberships available. These are paid upfront and begin on the membership start date. Monthly Memberships are rolling month-to-month until a cancellation date is specified. If you do not advise the memberships department of your preferred cancellation date, the contract will automatically renew, and you will be charged and invoiced accordingly. All memberships are non-refundable and cannot be placed on hold. The Monthly Membership Tiers are as follows:

• Gold Membership – Tier 1 – 20 day passes per calendar month.

• Silver Membership – Tier 2 – 12 day passes per calendar month.

• Bronze Membership – Tier 3 – 8 day passes per calendar month.

  1. Membership Fees & Deposit:

(a) Annual House Membership charges will be billed either; Annually, Quarterly or Bi-Annually. This selection can be made once at the application stage of your membership only. All invoices will be charged together with due dates according to the selection.

(b) Monthly Membership fees will be processed monthly for rolling contracts until the membership department is notified of the cancellation date. The date the charges and invoices are issued, is approximately the same day of each month, as the initial membership start date.

(c) Payment: you agree to pay us in cleared funds, any membership fees due or any other payments incurred by you under or in connection with these Terms or your membership.

(d) Payment methods: Payment methods will be communicated to you at the time your membership is established.

Failure to maintain adequate payment may result in immediate membership suspension and in the Member not being admitted to Alberts.

  1. Member’s Food and Beverage Discount:

(a) Members are entitled to a 15% food and beverage discount on Palmer Eatery and Bar menus only (F&B Discount). The F&B Discount:

• excludes food and beverage catering for functions, events, or private hire.

• is not applicable to catering provided in Alberts Club Lounge, Theatre, Level 1 or Level 2 meeting spaces or in-office.

• may only be redeemed by the Member when showing proof of membership as required.

• is only redeemable at point of sale for items paid for by the Member (i.e., not items paid for by the Member’s Guest/s).

• is limited to three (3) Guests per paying Member (i.e., a maximum of four (4) persons discounted). Payment of the bill may not be split. The Member must be paying for the total bill to receive the F&B Discount.

• is at the sole discretion of the Manager on Duty of Palmer Eatery and Bar and can be withheld or revoked for any reason.

(b) The F&B Discount is subject to change with or without notice, at any time by Alberts management.

  1. Applying for Membership: All Tiers of Alberts membership can be applied for using the Membership Application Form sent by Alberts management.

  2. Membership Renewals & Cancellation:

(a) Annual House Membership holders will be contacted thirty (30) days prior to cancellation term with a right to renewal.

(b) Those on quarterly and bi-annual payments must provide at least thirty (30) days’ notice to cancel an Annual House Membership and any outstanding dues must be paid before the cancellation date. Cancellation of an Annual House Membership is only applicable via written notice to memberships@alberts.nz. Within that time, all outstanding balances must be settled, and any other Alberts property returned.

(c) Membership changes are entirely up to the discretion of Alberts management.

  1. Member Access via App/Members Portal: Alberts will provide each Member with access credentials for the Alberts app and web Members portal. Members are required to present their app upon arrival to gain access to Alberts. The app is for Members’ use only. Your membership entitles you to access and use the Members portal. Your Members portal login details are personal to you and must not be shared with anyone else. You should take sufficient care in ensuring the security of your login details and contact us immediately if you believe that someone else has access to them or is using them. You must use the Members portal in accordance with the terms of use accepted by you when you first login, as amended from time to time.

  2. Guests: Alberts membership is for your personal use only. Members are entitled to bring a maximum of 3 guests per visit, except when attending a meeting, in which case, all attendees must be registered with the concierge in advance. Guests and employees who are not Members are not permitted without the inviting Member present. All guests must sign in at the front desk upon arrival before being granted access to Alberts. Guests of Members may not be offered access to Alberts until the Member is present. Members must remain with their guests at all times. Members are fully responsible for the conduct and behaviour of their guests and for all facilities used by them at Alberts. Members should employ fair and proper usage when inviting guests. If the same guest is in the space with a frequency that Alberts management considers to be excessive, then that guest may be refused further entry and/or may be invited to apply for Alberts membership.

  3. Children: Children of Members and their guests are welcome at Alberts. However, they must be supervised at all times and comply with the house rules and regulations.

  4. Pets: No pets will be permitted in Alberts communal areas except for assistance dogs, i.e., dogs individually trained to perform tasks or do work for the benefit of a person with a disability.

  5. Dress code: Alberts enforces a casual business attire. Sandals, men’s shorts, active and gym wear are not permitted in the space, without the prior agreement of Alberts management. Members are to inform their guests of these standards before arrival and will be fully responsible for their appearance. Admittance will not be granted to any Member or guest should they not adhere to the dress code.

  6. Food & Beverage: No outside food or beverage is permitted inside Alberts Club Lounge. Food may be consumed on Level 1 in The Commons and The Library or Level 2 kitchenette of 1 Albert Street.

  7. Smoking/Vaping Policy: Alberts has a strictly no smoking / vaping policy, including on balconies, at all times.

  8. Mobile Phones, Noise level & Audio Visual: Members and their guests should be mindful of, and courteous to other Members, guests, and neighbours when it comes to the use of phones. Taking or making phone calls in the shared spaces is permitted. Members and guests are encouraged to conduct calls, Teams, FaceTime, or video meetings in designated areas and meeting rooms. Any audio should be enjoyed with headphones.

  9. Photos, Social Media & Press: As Alberts is a private members club, we advise you that camera, video and recording devices are prohibited when on club premises. Alberts reserves the right to take ownership of any recordings or images used or taken while on our premises and we have a strict no social media and press policy.

It is at Alberts management’s full discretion to determine what is deemed appropriate. Noncompliance may lead to membership suspension or termination. Sharing unauthorised information about Alberts on social media or with the press including, without limitation, the identity of any Member or guest, is strictly prohibited and grounds for membership termination. Members must ensure their guests are complying with these Terms.

Alberts reserves the right to make recordings or images from time to time for promotional purposes. Alberts does so at its sole discretion and without prior notice to Members. Alberts will make an effort to display appropriate signage if recordings occur. All Members provide Alberts with the irrevocable right to use such recordings or pictures in its communication.

  1. Confidentiality: Members, guests and staff are held to strict confidentiality standards regarding Members, guests, and any events taking place at Alberts. Any information acquired while at Alberts must be kept in the strictest confidence and in conformance with our privacy policy. Please respect the privacy of other individuals and events in the building and refrain from entering in spaces that have been hired. These include, without limitation, shared spaces, club lounges, theatre, meeting rooms, dining spaces and offices.

  2. Appropriate Conduct: Alberts holds sole discretion of entry of any Member or guest. Should the activities of any Member or guest be determined illegal, disruptive, inappropriate, or potentially a legal or reputational liability inconsistent with these Terms, the Membership Agreement, or any of Alberts policies (as the case may be). Alberts reserves the right to refuse service or entry or to expel such Member or guest from the premises. Alberts management reserves the right to refuse service and escort patrons off premises at any time for any reason or no reason. No harassment will be permitted at Alberts. Any such harassment shall be immediately reported to Alberts management. If the complaint is justified, the offending party’s membership may be immediately terminated. Members may not disseminate any information related to Alberts or its Members or their guests that in any manner violates the statutory or common law privacy rights of other Members or their guests.

  3. Complaints and Dispute Resolution process: If a Member has a problem, concern, or complaint about any part of our services they should contact membership@alberts.nz. We will use our best effort to respond to a Member’s complaint if we believe it reasonable to do so. If a dispute arises between you and Alberts, both parties must follow the dispute resolution process set out below:

(a) The parties will engage in good faith negotiations and take all reasonable steps to promptly resolve any dispute between them.

(b) If the dispute is not resolved by negotiation within fourteen (14) days of either party notifying the other of the dispute in writing (Notification of Dispute), either party may require the other party to engage in mediation with the assistance of a qualified mediator.

(c) If the dispute is not resolved within twenty-eight (28) days after Notification of Dispute, either party may take its own steps to seek relief before the appropriate court.

(d) We reserve the right to temporarily suspend a party’s membership if any dispute is unable to be resolved within seven (7) days after we receive a Notification of Dispute, until the dispute is resolved, or the party’s membership is cancelled / terminated in accordance with these Terms.

  1. Membership Property: We are not responsible for any property you leave behind, is stolen or goes missing at Alberts. Members are solely responsible for the safety, partial or total loss, damage, theft, and security of their personal belongings and those of their guests.

  2. Mail: Alberts Members may receive personal letters and small packages to the Alberts address in common amounts (i.e., fewer than 3 pieces of mail per day, per Member). Alberts Concierge notify via the Members portal of incoming mail. It is the Member’s responsibility to inquire and retrieve such mail. Any unclaimed personal items will be returned to sender or donated or destroyed after fourteen (14) days from its receipt.

  3. Personal Information & Change of Address: We require all active Members of Alberts to have on file, current information including: photo, short bio, email, address, phone number. Members are responsible for updating their personal contact information with Alberts in order to receive any notices and up-to-date information.

  4. Meeting Rooms & Bookings:

(a) Meeting rooms are available at Alberts for use by Members based on availability and all meeting rooms must be booked online through our website, the Members portal or via Alberts Concierge team.

(b) Meeting rooms must be returned to the original condition it was in prior to the booking. Any damage to the fixtures and fittings, walls, doors, AV system or otherwise will be charged back to the Member and/or client. Alberts does not allow paper or other items to be placed on the walls in the meeting rooms. Alberts Concierge team can provide you with whiteboards should you need them.

(c) Meeting rooms are for Members and clients to use for meetings, they are not to be used to house Member’s guests who wish to work for the day. Should you have guests wanting to work in the space, please purchase a day pass from reception.

  1. Liability & Insurance:

(a) We maintain a public liability insurance policy that covers Alberts spaces, and we carry our own contents insurance. Our contents insurance does not extend to your property or the property of your guests. You understand that you should make your own insurance arrangements to ensure that your property and any other liabilities are covered, including public liability.

(b) You agree that under no circumstances are we responsible for loss or damage to any of your property left unattended or unsecured or for damage caused by any other party. We will not be liable for any indirect or consequential loss, including any loss of actual or anticipated business, income, or loss of opportunity.

(c) You agree to indemnify us for any loss incurred by us or any claim against us resulting from a breach of you by these Terms or any action of your employees or guests.

(d) We are not liable for actions of other individuals. We do not control and are not responsible for the actions of other individuals using the services at our premises. You should be aware that other users or Members may not be who they claim to be. We do not perform background checks on our users or Members, nor do we guarantee that our users’ or Members’ profiles are accurate. We do not endorse, support, or verify the facts, opinions or recommendations of our users or Members.

(e) Except to the extent permitted by law, nothing in these Terms shall exclude or limit any rights or remedies you may have under New Zealand Consumer Law.

(f) From time to time, we may investigate any actual, alleged, or potential violations of these Terms. You agree to cooperate fully in any of these inquiries. You waive any and all rights against Alberts and agree to hold them harmless in connection with any claims relating to any action taken by us as part of our investigation.

  1. Third Party Products and/or Services: We do not have liability for third-party products or services. During the course of your membership, you may be provided with access to third-party products or services. You may also be provided with access to advertisements or services from other third-party business partners. We are not responsible for the content of these third-party advertisements or any links or any products, services or other materials relating to any third-party (collectively, Third-Party Products). In no event will we be liable, directly, or indirectly, to anyone for any damage or loss relating to any use of, or reliance on, any Third-Party Products. You agree that our making available access to, or discounts for these Third-Party Products does not constitute provision of such Third-Party Products by us, and you will look solely to the applicable third party for provision of the applicable Third-Party Products and for compensation for any claims, damages, liabilities or losses you may incur in connection with such Third-Party Products.

  2. Force Majeure: Sometimes events happen that are out of our control. These include things such as strikes, lock outs, accidents, war, fire or the delay or failure in manufacture, production, or supply by third parties of equipment or services. Such events may prevent us from providing you with access to Alberts, providing our services, in whole or in part, or may prevent you from performing your obligations under these Terms. In such cases both parties agree that the other party will not be liable for any delay or failure in performing their obligations. Nothing contained in this clause will excuse payment of any money you owe us, or which becomes due under these Terms.

  3. Alberts Privacy: We are committed to maintaining the confidentiality and security of your personal information and managing it in an open and transparent way. We take our obligations under the New Zealand Privacy Act 2020 and the New Zealand Privacy Principals very seriously and have implemented practices, procedures, and systems to ensure we comply with those laws. You can access our privacy policy by contacting memberships@alberts.nz.

  4. Tenant Members: Terms will apply (with appropriate adjustments) to members/users who have attained membership pursuant to any lease arrangements with the Member or the Tenant (pursuant to any lease arrangements). By using that facilities each such Member agrees to comply with the relevant Terms.

  5. Mail-outs: All new Members will be automatically signed up to receive email marketing communications. A Member may remove themselves from any email marketing communications by following the "unsubscribe" prompt at the bottom of each email.

  6. Updates to Rules: The membership terms and conditions, Alberts Club Rules & regulations, the levels of membership and the benefits may change in the future at any time at our discretion. We will communicate any changes to Albert club rules via our website, the Members portal or by other means of communication.

  7. Defined Terms:

Alberts, us, our and we mean Alberts Auckland Limited and its Members club and associated facilities.

Albert Club Rules means the Albert club rules as updated from time to time.

Member means a current member of Alberts, as named on that Member’s membership form.

Membership Application Form means the membership application required to be completed for membership.

Membership Term means the minimum length of time you commit to being a Member.

Terms means these terms and conditions.

You and your means the Member of Alberts, as named on your Membership Application Form.

Acceptance of Terms & Conditions:

By accepting, I acknowledge that I have received, read, and understand these terms and conditions set out below, including my rights regarding cancellation and payment options and agree to be bound by these terms and conditions.
